This essay is devoted to critical analysis of the Deliberative School in contemporary human rights discourse. The Deliberative School is most trusted by the views of two of the most important contemporary thinkers, Jürgen Habermas and John Rawls, in political philosophy. These two thinkers consider dialogue and counseling as one of the most important tools for achieving consensus and empathy in normative affairs in human societies, albeit with different perceptions and approaches. The basic question here is whether, as the advocates of the Deliberative School think, dialogue and consultation are the means for reaching a consensus on human rights and moral values? Deliberation and dialogue in some cases may lead not only to consensus but also to results such as assimilation of minorities and imposing certain values on other values or domination of the majority on the minority. در گفتمان حقوق بشر معاصر چهار مکتب را می‌توان شناسایی نمود که عبارت‌اند از مکتب حقوق طبیعی، مکتب اعتراض، مکتب رایزنی و مکتب گفتمان. این جستار به تحلیل انتقادی مکتب رایزنی در گفتمان حقوق بشر معاصر اختصاص دارد. مکتب رایزنی بیش از همه وامدار نظریات دو تن از مهم‌ترین اندیشمندان دوران معاصر یعنی یورگن هابرماس و جان راولز در فلسفه سیاسی است. این دو متفکر گفتگو و رایزنی را هرچند با برداشت و رویکردی متفاوت، از مهم‌ترین ابزارهای دستیابی به اجماع و همدلی در امور هنجاری در جوامع بشری می‌دانند. پرسش اساسی این است که آیا همان‌گونه که این دو اندیشمند می‌پندارند، گفتگو و رایزنی ابزار رسیدن به اجماع در مورد حق‌های بشری و ارزش‌های اخلاقی است؟ این جستار به روش تحلیل انتقادی صورت گرفته است. ازجمله نتایج تحقیق اینکه مشورت و گفتگو در مواردی ممکن است نه‌تنها به توافق و اجماع منجر نشود بلکه به نتایجی همچون یکسان‌سازی اقلیت‌ها و تحمیل ارزش‌های خاصی بر ارزش‌های دیگر و یا سلطه اکثریت بر اقلیت منجر شود. https://humanrights.mofidu.ac.ir/article_38389_a234673350319edb8a0aa1cd94236d48.pdf
