دانشگاه مفید دوفصلنامۀ بین‌المللی حقوق‌بشر 2423-6489 20 1 2025 06 22 Legal aid for children; Basics and mechanisms معاضدت حقوقی برای کودکان؛ مبانی و ساز و کارها 35 57 732575 10.22096/hr.2025.2050010.1707 FA محمد مهدی مقدادی دانشیار، دپارتمان حقوق، دانشگاه مفید، قم، ایران. 0009-0009-1326-7656 Journal Article 2025 01 06 <span lang="EN">Children are the most vulnerable group of human society due to their physical and mental disabilities.</span><span lang="EN"> </span><span lang="EN">This is why there is no doubt in </span><span>protect</span><span lang="EN">ting children, especially in special and dangerous situations such as cases of child abuse, conflicts and family problems.</span><span lang="EN"> </span><span lang="EN">Among these protections are support and legal services for them, which are done in the framework of legal aid.</span><span lang="EN"> </span><span lang="EN">But unfortunately, this important issue has not been considered in our country</span><span lang="EN"> </span><span lang="EN">and for this reason, Legal aid for children is explained and implemented in a traditional manner, like ordinary citizens, alongside them.</span><span lang="EN"> </span><span lang="EN">In this article, taking into consideration the </span><span>requirements of childhood</span><span lang="EN">, </span><span>child rights standards and necessities</span><span lang="EN">, as well as the developments in developed countries, an attempt has been made to present the concept of legal aid, the basics</span><span dir="RTL" lang="EN"> </span><span lang="EN">and new and efficient mechanisms for legal aid for children </span><span>(Children's Rights Clinic</span><span lang="EN">, friend of the court,</span><span> Child Legal Empowerment,</span><span lang="EN"> Street law</span><span>)</span><span lang="EN">.</span> <span lang="FA">کودکان به سبب ضعف جسمی و عدم تکامل روانی، آسیب‌پذیرترین قشر جامعه انسانی به شمار می‌روند. به همین دلیل است که در لزوم حمایت همه‌جانبه از کودکان، به‌ویژه در شرایط خاص و مخاطره‌آمیز همچون مورد آزار و سوءاستفاده قرار گرفتن، درگیری‌ها و مشکلات خانوادگی تردیدی نیست. ازجمله این حمایت‌ها، پشتیبانی و تأمین خدمات حقوقی مناسب برای آنان است که در قالب معاضدت حقوقی صورت می‌گیرد. متأسفانه این مسئله مهم تاکنون در کشور ما مورد عنایت لازم قرار نگرفته است و از همین رو معاضدت حقوقی کودکان به شکل سنتی و همانند شهروندان عادی و هم‌ردیف آنان تبیین و اجرا می‌شود. در این مقاله با نگاهی به اقتضائات کودکی، استانداردها و الزامات حقوق کودک و نیز تحولات صورت‌گرفته در کشورهای پیشرو، تلاش شده است مفهوم نوین معاضدت حقوقی، مبانی آن تبیین شود و سازوکارهای جدید و کارآمد برای معاضدت حقوقی کودکان (شامل کلینیک حقوق کودک، دوست دادگاه و آموزش حقوق به همگان) ارائه گردد.</span> https://humanrights.mofidu.ac.ir/article_732575_fb50be427a8f8d98ed2a143c82cb6bb9.pdf
