چشم‌اندازی به منزلت انسانی از منظر اخلاق‌زیستی و حق‌های بشری

چکیده

منزلت انسانی در گستره اخلاق زیستی به مثابه ارزشی بنیادین تلقی می‌گردد که در کنار حیات و دوام حیات برای بشر ضرروی بوده و جزئی لاینفک از وجود وی محسوب می‌شود. بدان سان که‌این مقوله، ارزش اخلاقی بنیادین برای بشر است، حقوق مأمور می‌گردد که به حمایت از آن اقدام کرده و تدابیر حمایتی خود را در‌این زمینه اتخاذ نماید. از‌این رو، منزلت انسانی که در عرصه اخلاق زیستی در سیمای «ارزش بنیادین اخلاقی» ظاهر می‌شود، در گستره حقوقی، در چهره «حق» پدیدار می‌گردد. با‌این اوصاف، نوشتار حاضر با تمرکز بر منزلت انسانی، ضمن پویش معنایی منزلت انسانی، به‌این مقوله زیست اخلاقی در دو جلوه ارزش و حق پرداخته و تلاش می‌کند با ورود به تنوع گونه‌های منزلت انسانی، مفهوم و گونه راستین آن‌را که در سپهر اخلاق زیستی مطلوب بوده، استخراج کرده و رویکرد‌های حمایتی از آن‌را در حوزه حقوق بین‌الملل بشر مورد مداقه قرار دهد.

چکیده English

In the area of bioethics, human dignity is as a basic value, being necessary for human being beside his life and continuousness of his life. As the issue is a basic value ethically, law will be agent to protect it and takes some actions in support of that. Thus, as human dignity appears as “a basic value ethically” in the field of bioethics it also comes into view as “a basic right legally” in the field of law. The article with emphasis on human dignity, along with defining human dignity, deals with the issue in the frames of ethical value and right, and attempts to describe the varieties of human dignity and its exact definition in the sphere of bioethics. Finally, protective approaches will be described on the base of human international rights law.
