حقوق شهروندی از چشم‌انداز نظریه شهروندی جهانی و قوانین و مقررات ایران

چکیده

تحلیل‌های گوناگونی از مفهوم شهروندی در گرایش‌های مختلف علوم انسانی ارائه شده است. به طور کلی، می‌توان شهروندی را در یک مفهوم به «حق نوین تمامی انسان‌ها برای زیستن و داشتن حقوق بنیادین» معنی کرد. با پذیرش این موضوع که حقوق شهروندی به همگان تعلق دارد و از این حیث نمی‌توان میان افراد تفاوت قائل شد؛ دو نتیجه مهم در روابط داخلی و بین‌المللی پدیدار می‌شود: نخست اینکه، شهروندی نماد هویت ملی همه اشخاصی به‌شمار می‌آید که در آن کشور ساکن هستند؛ دوم اینکه، با کمی دقت می‌توان دریافت که در برخورداری از حقوق بنیادین و مطالبه آن برای تمامی انسان‌ها در یک کشور، تفاوتی میان اتباع و دیگر افراد وجود ندارد. هر چند هر دو فرض به نوعی با چالش روبه‌رو هستند، در این مقاله مبانی نظری و آثار حقوقی و اجتماعی آنها بررسی خواهد شد.

Citizenship Rights from the View Point of Iranian Law and Global Citizenship

چکیده English

There are different analyses about the concept of citizenship in different fields of humanities. Generally, citizenship can be defined as "modern right of all humans to life and having fundamental rights". By accepting the fact that citizenship rights belong to anyone and there is no discrimination from the viewpoint of these rights, we can reach two important results in internal and international law: first, citizenship is the symbol of national identity of all persons in their origin countries and second, having these rights is not restricted to the nationals of a country but belong to any person. In this paper, challenges around these two prepositions are analyzed.
