چکیده
تحریم‌های اقتصادی اعم از یک‌جانبه یا مطابق با فصل هفتم منشور ملل متحد ابزاری قدرتمند برای واداشتن یک دولت به انجام تعهدات بین‌المللی‌اش تلقی می‌گردد. تحریم‌ها خواه ‌ناخواه آثاری بر جمعیت کشور هدف خواهند داشت آثاری که ابعاد منفی آن، گاه چنان عمیق است که تا سال‌ها قابل مشاهده است. حق بر آموزش نیز به عنوان حقی توانمندساز، از اثرات زیان بار تحریم‌های اقتصادی مصون نمانده است. این حق به واسطه ارتباط با سایر حقوق بشر از جمله حق بر غذا، حق بر آب، حق بر حداقل استانداردهای زندگی و ... در معرض نقض مستقیم و غیر‌مستقیم قرار دارد. این حق از حقوق غیر‌قابل انحراف تلقی می‌شود که حتی شورای امنیت نیز برای حفظ صلح و امنیت بین‌المللی نمی‌تواند آن را نادیده بگیرد اما، شورا در قطعنامه 1737علیه برنامه هسته‌ای ایران در بند 17 مستقیماً حق بر آموزش اتباع ایرانی را نقض نموده است.

چکیده English

Economic sanctions whether imposed unilaterally or on the basis of the chapter VII of the UN are a powerful means for enforcing a state to fulfill its international obligations. Sanctions, like or not, would have lasting negative impacts on the people of the targeted state. The right to education as an empowering right would not be excluded from the detrimental effects of the economic sanctions. Since this right is related to other human rights including the right to food, the right to water, the right to a basic standard of living, etc., it is directly or indirectly susceptible to breach. This right is considered as an inalienable right so that even the UN Security Council cannot ignore it for the purpose of protecting international peace and security. However, the Council, by adopting resolution 1737 (17) against Iran’s nuclear program, has violated the right to education of the Iranian citizens.
